Implementation of KPCS in India

India is one of the founding members of Kimberley Process Certification Scheme (KPCS).  The Scheme is administered through Department of Commerce, Ministry of Commerce and Industry, Government of India.  Department of Commerce, vide its letter No.12/13/2000-EP(G&J) dated 13/11/2002, have designated Gem and Jewellery Export Promotion Council (GJEPC) as the Import and Export Authority within the meaning of Section IV(b) of the Scheme.

 Vide Para 2.2 of Indian Foreign Trade Policy (2004-09), no import or export of rough diamonds shall be permitted unless the shipment is accompanied by Kimberley Process Certificate required under the procedure specified by the GJEPC.

 Based on the above, Central Board of Excise and Customs (CBEC), Ministry of Finance, Government of India, vide their Circular No.55/2003-Cus dated 23 June 2003 has issued detailed instructions to Customs field formation about the procedure to be adopted for import and export of rough diamonds.

 Under Special Economic Zone (SEZ) Rules, 2006 of Government of India, Development Commissioners have been delegated powers to issue Kimberley Process Certificates for units located in respective SEZs.

GJEPC has recently revamped its procedure for issue and endorsement of KP Certificates through implementation of a new online software that simplifies the process for exporters and importers based in India.
